Key Risk Insurance Company v Peck 252 NC App 127 (2017)
Court of Appeals upholds dismissal at the Trial Court level on a case of First Impression. Stephen Baynard was successful in defending Subrogation Action brought in the name of the Workers’ Compensation Carrier. Craven County trial court dismissed the matter for failure to bring in a claim in a name of the employee. This decision was a case of first impression in NC and the Court of Appeals upheld the Trial Court. The case received national attention and appeared in several national publications on this issue of law.
