The Court of Appeals upholds Summary Judgment in favor of the Defendant at the trial level. Stephen Baynard secured Summary Judgment on behalf of the Defendants in a trip and fall, where the Plaintiff fell and fractured both of her legs. The trial court dismissed the case on the grounds that the Plaintiff had equal or superior knowledge to the Defendant. The Court of Appeals unanimously upheld the trial court’s ruling.
